1 Privacy Policy and California Privacy Notice
Skin Touch Clinic (“Skin Touch,” “we,” “us,” or “our”) respects your privacy. This policy explains how we collect, use, disclose, retain, and protect personal information when you visit our website, contact us, book a visit, purchase services or products, or otherwise interact with us. It does not replace our Notice of Privacy Practices, which applies to protected health information when HIPAA applies.
Information We Collect
• Identifiers and contact information, such as name, email address, phone number, mailing address, date of birth, and preferred language.
• Appointment and transaction information, such as requested service, appointment date, provider, purchase, payment status, package balance, and communications with us. Payment card data is processed by our payment processor; we do not intentionally store full payment-card numbers on our website.
• Health and treatment information that you provide through a secure intake or patient system. This may be protected health information and is addressed in our Notice of Privacy Practices.
• Internet and device information, such as IP address, browser, device identifiers, pages viewed, interactions, referral URL, and cookie or similar-technology data.
• Audio, visual, and electronic information, such as photographs, treatment images, messages, call recordings where permitted by law, and signed forms. We obtain separate authorization before using identifiable treatment photos for marketing.
How We Use Information
• To provide, schedule, administer, and improve services; process payments; respond to requests; send appointment reminders; maintain records; protect patients and the clinic; and meet legal obligations.
• To send marketing only when permitted by law and consistent with your choices. Marketing consent is not required to receive medical care.
• To operate and improve our website, detect fraud or security incidents, and measure advertising performance only as described in this policy and our cookie notice.
How We Share Information
We may disclose information to service providers that help us operate the clinic and website, including booking, electronic health record, payment, communications, hosting, security, accounting, and professional-advisory providers. We may also disclose information when required by law, to protect rights or safety, or in connection with a lawful business transaction. We do not sell your medical information. We do not share it for cross-context behavioral advertising without the required authorization or opt-out rights.
California Privacy Rights
California residents may have rights to know, access, correct, delete, and limit certain uses or disclosures of personal information, and to opt out of sale or sharing where applicable. Some information, including protected health information and information subject to medical-privacy laws, may be exempt from parts of the California Consumer Privacy Act. To submit a request, contact [PRIVACY EMAIL / WEB FORM] or call [PHONE]. We will verify requests reasonably and will not discriminate against you for exercising applicable privacy rights. You may use an authorized agent as permitted by law.
We retain information only as long as reasonably necessary for the purpose collected, to provide care and services, comply with legal and record-retention duties, resolve disputes, and enforce agreements. We use reasonable administrative, technical, and physical safeguards, but no system is completely secure.
Children
Our website is not directed to children under 13. We do not knowingly collect personal information from a child through the website without a parent or legal guardian’s involvement. A parent or guardian must accompany or provide legally valid consent for services to a minor, where applicable.
Changes and Contact
We may update this policy. The effective date above shows when it was last revised. Questions may be sent to [PRIVACY OFFICER NAME], [EMAIL], [MAILING ADDRESS], or [PHONE].
2 Notice of Privacy Practices
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
[Skin Touch Clinic legal entity] is required by law to maintain the privacy and security of your protected health information, give you this notice of our legal duties and privacy practices, and notify you following a breach of unsecured protected health information when required by law. We will follow this notice while it is in effect.
How We May Use or Disclose Your Information
• Treatment: We may use or disclose information to provide, coordinate, or manage your care, including communication with other treating professionals when appropriate.
• Payment: We may use or disclose information to obtain payment, process charges, determine coverage, or carry out related billing activities.
• Health Care Operations: We may use or disclose information to operate and improve our practice, conduct quality assessment, train staff, manage risk, and comply with legal obligations.
• Other permitted or required uses: We may use or disclose information as required by law and for certain public-health, oversight, workers compensation, law-enforcement, judicial, and safety purposes, subject to applicable legal limits.
We will obtain your written authorization for uses or disclosures not described in this notice when required, including most uses of psychotherapy notes, most marketing that involves payment, and sale of protected health information. You may revoke an authorization in writing, except to the extent we already acted in reliance on it.
Your Rights
• Request a copy of or inspect your medical record, subject to legal limits and permitted fees.
• Request correction of information you believe is incorrect or incomplete.
• Request confidential communications, such as contacting you at a different address, phone number, or email.
• Ask us to limit certain uses or disclosures. We are not required to agree to every request, except as applicable law requires, including certain restrictions on disclosures to a health plan when you pay out of pocket in full for the relevant service.
• Request an accounting of certain disclosures and obtain a paper or electronic copy of this notice.
• File a complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights. We will not retaliate against you for filing a complaint.
To exercise a right or make a complaint, contact [PRIVACY OFFICER NAME, ADDRESS, PHONE, EMAIL]. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights. We may revise this notice; a current copy will be available at the clinic and on our website.
3 Website Terms and Conditions
By using this website, booking an appointment, or purchasing a non-medical product or service through Skin Touch, you agree to these Terms and Conditions and our posted policies. If you do not agree, do not use the website or booking tools.
Website Information Is Not Medical Advice
Website content is for general informational and educational purposes only. It does not create a provider-patient relationship, diagnose a condition, replace an in-person evaluation, or guarantee treatment suitability or results. In an emergency, call 911 or seek emergency care. Treatment requires an appropriate consultation, medical assessment, informed consent, and the judgment of the licensed professional.
Appointments and Eligibility
An appointment request or online purchase does not guarantee that a treatment is medically appropriate, available, or will be performed. We may decline, postpone, modify, or stop a service when clinically appropriate, for safety reasons, for a legal or licensing reason, or if required information or consent is missing. Patients must provide accurate information and promptly update changes that could affect care.
Pricing and Promotions
Prices, offers, memberships, and availability may change prospectively without notice unless a written agreement states otherwise. Taxes, provider fees, product fees, and any financing terms will be disclosed before payment where applicable. Promotions cannot be combined unless we say so, have no cash value, and are subject to stated expiration dates, eligibility conditions, and medical appropriateness.
Intellectual Property and Acceptable Use
The website’s text, design, logos, images, and other content are owned by or licensed to Skin Touch and may not be copied, modified, distributed, or used commercially without written permission. You may not interfere with website security, upload harmful code, impersonate another person, scrape the site unlawfully, or use the website for an unlawful purpose.
Disclaimers and Liability
To the fullest extent permitted by law, the website is provided “as is” and “as available.” Individual treatment outcomes vary. Nothing in these Terms limits rights or remedies that cannot lawfully be limited, including rights related to professional negligence or consumer protection.
Governing Law and Changes
California law governs these Terms, without regard to conflict-of-law principles. Venue for a dispute that may lawfully be brought in court will be in the appropriate state or federal court serving Los Angeles County, California, unless a written agreement provides otherwise. We may update these Terms by posting a revised version with a new effective date.
4 Appointment Cancellation No Show Refund and Package Policy
This policy applies to appointment reservations, deposits, prepaid services, packages, memberships, and retail products unless a written offer or contract expressly states otherwise.
Appointments and Cancellations
Please cancel or reschedule at least 24 hours before your appointment. A cancellation, late arrival, or missed appointment with less than 24 hours’ notice may result in a [$___] late-cancellation fee, loss of the deposit, or forfeiture of the reserved prepaid service, as disclosed at booking. We may waive a fee in our reasonable discretion for documented emergencies; a waiver is not guaranteed and does not change this policy for future appointments.
If you arrive late, we will try to provide the remaining scheduled time when safe and practical, but your service may be shortened, rescheduled, or treated as a late cancellation. Repeated late cancellations or no-shows may require a deposit or prepayment for future bookings.
Deposits and Prepaid Services
Deposits are applied to the scheduled service when completed. Except where required by law or expressly stated otherwise, deposits and prepaid services are nonrefundable after purchase. If a licensed provider determines that a purchased treatment is not medically appropriate before it is performed, Skin Touch may offer a refund or clinic credit, as required by law or in Skin Touch’s written discretion.
Packages and Credits
Packages and treatment credits are personal to the original purchaser or patient, not transferable, not redeemable for cash, and may not be resold. They may be used only for the services and locations stated at purchase, subject to medical appropriateness, provider availability, and any written expiration rules that comply with applicable law. If a service in a package is unavailable or medically inappropriate, Skin Touch may offer a reasonably comparable clinic credit or another lawful resolution. Unused promotional value may expire only as allowed by law.
Products and Results
Unopened, unused retail products in their original condition may be exchanged or returned within [7] days with proof of purchase, except for final-sale items, products that cannot be safely resold, and products restricted by law. Because medical-aesthetic outcomes vary and are not guaranteed, completed services are not refundable solely because the result differs from a patient’s expectation. Concerns about a treatment must be reported promptly so our clinical team can evaluate the issue.
Chargebacks
Please contact us first at [PHONE/EMAIL] to resolve a billing concern. We may provide records and documentation to a payment processor or financial institution to respond to a disputed charge, consistent with applicable privacy laws.
5 SMS Text Messaging Terms and Consent
Skin Touch may send text messages for appointment confirmation, reminders, follow-up coordination, account notices, and, only with the appropriate consent, promotional offers. Message frequency varies. Consent to receive marketing texts is not a condition of purchasing any goods or services.
Consent and Opt Out
By checking an unchecked consent box, signing a separate consent, or otherwise affirmatively agreeing to receive text messages, you authorize Skin Touch and its service providers to send recurring autodialed or non-autodialed texts to the mobile number you provide, where permitted by law. Message and data rates may apply. Reply STOP to cancel promotional texts at any time. After you text STOP, you may receive one final confirmation message. Reply HELP for help or contact [PHONE].
We will honor reasonable requests not to receive texts. Opting out of promotional texts does not prevent us from using another lawful method to communicate about care, safety, billing, or a scheduled appointment, unless you request otherwise and we can reasonably accommodate it. Do not send urgent medical information by text. Text messages may not be secure; use [SECURE PORTAL/PHONE] for sensitive medical questions.
Required Booking Checkbox Language
